DNA Is Useless: Court Suspends Parental Rights After Woman Sleeps With Identical Twins in 4 Days

LONDON — In a highly unusual and complex family dispute, a court has ruled that it is currently impossible to determine the biological father of a child after a woman had intimate relations with identical twin brothers within a four-day window.

The case, heard at the Court of Appeal in London, resulted in the suspension of parental responsibility for the man previously listed as the father on the birth certificate. Because the brothers share identical DNA, scientific testing cannot definitively pinpoint which of the two men fathered the child—leading to a bitter legal battle that has strained the twins' relationship.

The Biological Dilemma

The woman, who cannot be named for legal reasons, conceived the child after sleeping with both identical twins during the exact same conception window.

Judge Reardon's Findings

Earlier findings by Judge Madeleine Reardon revealed the timeline of events. "Both brothers had had sex with the woman within four days of each other in the month when P was conceived, and it was equally likely that each of the brothers is P’s father," the judge noted.

Why DNA Fails Here

Because identical twins originate from the same fertilized egg, they share virtually identical genetic profiles. Standard paternity DNA tests look for genetic markers inherited from the father, but in this case, those markers are identical in both men, making standard testing completely useless.

The Court's Verdict

Without scientific proof, the court was forced to suspend parental rights.

The Birth Certificate Dispute

When the child was born in 2017, the woman was in a relationship with one of the twins, who was subsequently registered as the father on the birth certificate. However, after the couple separated in 2024, both brothers began claiming the child as theirs, sparking the current legal proceedings.

Sir Andrew McFarlane's Ruling

Delivering the judgment, Sir Andrew McFarlane stated: "Currently, the truth of P’s paternity is that their father is one or other of these two identical twins, but it is not possible to say which." He ruled that being named on the birth certificate did not prove biology. "The first twin was not entitled to be registered as the father and any parental responsibility he had shall cease."

The £90,000 Question

While standard DNA testing has failed, next-generation sequencing might hold the answer—but at a staggering cost.

A Six-Figure Test

The court heard that advanced genetic sequencing, which looks for ultra-rare mutations that occur after the embryo splits, could potentially solve the mystery. However, this testing is estimated to cost around £90,000 (approximately US$113,400 or R2,120,000).

Waiting for Maturity

Due to the exorbitant cost, Sir Andrew noted that the issue must be shelved for now. "It is possible, indeed likely, that by the time P reaches maturity, it may be possible for science to identify one father and exclude the other twin, but, for the coming time, that cannot be done without very significant cost."

Legal experts have described the ruling as exceptionally rare. Emma Hubbard, a senior associate at Hall Brown Family Law, stated: "The circumstances of this case are relatively unusual. I certainly can’t think of another one involving the same complications."

The Mother's Sole Burden

Because the court suspended the first twin's parental rights, the child is currently left in a legal gray area. Hubbard added: "Where no definite biological link can be proven, it means a child may grow up having only a mother with parental responsibility for them." The case remains ongoing.
