‘We Are Not Ready’: Thabo Bester’s Legal Team Threatens Withdrawal Ahead of High-Stakes Pre-Trial Hearing

Bester, who notoriously faked his own death to escape the privately-run Mangaung Prison in 2022, last appeared virtually in June. With the trial provisionally scheduled for the first quarter of 2027, this Friday’s hearing is a critical checkpoint to establish whether all outstanding interlocutory matters have been resolved. According to the defense, they have not.

Isolation at eBongweni: A Breakdown in Defense

Bester’s transfer to South Africa’s most secure facility has reportedly severed his ability to mount a proper legal defense, pushing his lawyers to the brink of withdrawal.

The court has been informed that there has been absolutely no contact between Bester and his legal team since his transfer to the eBongweni Super Maximum Correctional Centre in KwaZulu-Natal in January this year. Attempts to elicit a response from the Correctional Services Department regarding consultation access have reportedly been futile.

"We Are Not Ready to Proceed" Bester’s lawyer, Moafrika Wa Maila, explicitly warned the court of the strained lawyer-client relationship. “We are not ready to proceed unless our matter will be addressed,” he stated. “Number one, we have not been able to consult with accused number seven due to his occasional transfer to eBongweni Maximum Security, and equally so we have not yet received the docket because we have not been instructed in that direction.”

Unresolved Interlocutory Demands Beyond basic consultation, Bester is fighting multiple interlocutory battles. He is actively seeking court orders to have his bank accounts unfrozen, gain access to a laptop for trial preparation, and secure more relaxed prison conditions—requests that continue to complicate the pre-trial phase.

Prosecution Pledges Intervention

Desperate to prevent further delays, the State has committed to stepping in to facilitate access between Bester and his legal counsel.

Recognizing that the lack of consultation is a legitimate ground for trial postponement, the prosecution has formally committed to engaging the Department of Correctional Services.

State Prosecutor's Commitment State Prosecutor Adv. Dansi Mpemvane assured the court that the State would intervene: “I will avail myself to assist with the help of the investigating officer that arrangements are made for a proper consultation.” The judge had previously issued a stern warning against any further delays, insisting that the matter must proceed to trial.

The Co-Accused and the ConCourt Gambit

As Bester fights for prison access, his alleged accomplice, Dr. Nandipha Magudumana, is fighting the legality of her arrest entirely.

Magudumana’s legal team argued that proceeding with the trial before the Constitutional Court rules on her appeal would be a waste of judicial resources. Her appeal regarding her April 2023 apprehension in Tanzania was heard by the apex court in May, where she seeks to have her arrest and deportation declared unlawful.

The Cell 35 Decoy Plot The charges against the syndicate are severe. Bester and his co-accused—which include former G4S employees Senohe Matsoara, Teboho Lipholo, Tieho Makhotsa, Joel Makhetha, Magudumana’s father Zolile Sekeleni, and her Zimbabwean driver Zanda Moyo—are accused of smuggling the body of Katlego Bereng into Cell 35 and setting it alight to fake Bester's death.

The Thabo Bester saga represents one of the most profound embarrassments to South Africa's correctional and private security frameworks. However, the current pre-trial gridlock highlights a different systemic vulnerability: the balance between extreme security measures and constitutional legal rights.

By holding Bester at the hyper-secure eBongweni facility, the state ensures he cannot repeat his Mangaung escape. Yet, this very isolation is providing his defense with the perfect legal ammunition to stall the trial. If Moafrika Wa Maila follows through on the threat to terminate representation due to a lack of instructions and access, the court will be forced to grant a postponement for Bester to secure new counsel—pushing the provisional Q1 2027 trial date even further into the horizon.

Combined with Dr. Magudumana’s pending Constitutional Court ruling, Friday’s hearing is less about setting a trial date and more about preventing the state's flagship prosecution from collapsing under the weight of procedural and administrative delays.
