SDA Evangelist Marufu Walks Free as High-Profile Cyberbullying Case Collapses

Cyberbullying allegations against prominent Seventh-Day Adventist (SDA) preacher Evangelist Marufu have spectacularly collapsed after his three accusers formally withdrew their complaints this past Friday, putting an end to a highly publicized legal drama.

THE BURDEN OF PROOF: The defense team successfully argued that the state needed to provide hard data from Meta to link the preacher to the Facebook account in question.

The case, which centered around alleged disparaging remarks made on a viral online video, hit an insurmountable roadblock when the defense team, led by top lawyer Admire Rubaya, challenged the prosecution to produce undeniable digital forensics linking the evangelist to the Facebook account in question. Without corroborating data from Meta, the social media giant, the accusations crumbled.

The Accusations That Sparked the Case

The allegations threatened to severely damage the reputation of the popular religious figure, springing from an increasingly volatile online environment.

The Three Accusers The complaint was officially lodged by three individuals: Rotina Mafume Musara, Alasia Mbiriri, and Perseverance Muzeya. They claimed to have been the victims of targeted online harassment allegedly orchestrated by the clergyman.
The Disparaging Remarks The trio accused Evangelist Marufu of making disparaging and defamatory remarks against them in the comment section of a video shared widely on Facebook. The comments reportedly caused significant emotional distress, prompting the initial police report.

Admire Rubaya's Ironclad Defense

Instead of arguing the contents of the comments, the defense took a tactical approach, challenging the very digital foundation of the accusations.

Represented by legal powerhouse Admire Rubaya, Evangelist Marufu’s defense challenged the complainants to prove beyond a reasonable doubt that he was the individual behind the keyboard.

The "Ghost Account" Argument In the era of spoofed accounts, trolls, and digital impersonation, Rubaya argued that simply seeing a name or picture on a profile does not constitute legal proof of ownership or authorship.
The Meta Report Ultimatum The defense formally demanded that the state acquire an official report from Meta (the parent company of Facebook) containing IP addresses and login data. This report would be the only way to definitively prove the preacher owned the Facebook page and was the specific individual who posted the offending content.

The Withdrawal and Freedom

Faced with the high burden of digital proof, the case against the evangelist swiftly disintegrated.

Without the requested data from Meta, the complainants chose to abandon the legal battle on Friday.

Charges Dropped Rotina Mafume Musara, Alasia Mbiriri, and Perseverance Muzeya officially withdrew their complaints. The latest development means all cyberbullying charges have been dropped, and Evangelist Marufu is a free man.
Return of Property Following the collapse of the case, the investigating officer advised the clergyman to collect his cellphone, which had been previously seized by the police for forensic cyber-analysis.

The Burden of Proof in the Digital Age

This case sets a notable precedent for how cyberbullying and online defamation cases are prosecuted in Zimbabwe.

Screenshots Are Not Enough The collapse of this case highlights a critical reality in cyber law: mere screenshots of social media comments are often insufficient for a criminal conviction. Defense lawyers can easily argue that profiles were hacked, cloned, or fabricated.
The Power of Big Tech Data Without subpoenas compelling tech giants like Meta, Google, or X (formerly Twitter) to hand over server-side data, prosecuting online speech remains a highly complex and difficult legal endeavor.
