A Gun Stunt Comes to Haunt: Julius Malema Sentenced to 5 Years in Prison
Reported By: Sona Headlines Africa Desk | Sponsored by: Sona Solar Zimbabwe
A publicity stunt has officially come back to haunt one of the continent's most firebrand politicians. Julius Malema, the 45-year-old leader of South Africa’s Economic Freedom Fighters (EFF), has been dealt a stinging blow after being sentenced to five years in prison for the illegal possession and discharge of a firearm in public.
Magistrate Twanet Olivier handed down the sentence in the southern coastal town of KuGompo City (formerly East London). However, she granted the opposition leader leave to appeal against the verdict and sentencing, meaning Malema will not immediately be taken into custody.

Breaking Down the Conviction
The charges stem from an incident during the EFF's fifth-anniversary celebrations in the Eastern Cape province in 2018.
A Viral Video
Footage emerged showing Malema using what appeared to be a semi-automatic rifle to fire several shots into the air to rouse the crowd. The video quickly went viral on social media, prompting Afrikaner lobby group AfriForum to open a case against him.
The "Toy Weapon" Defense
During the trial, Malema’s defense argued that the firearm was not his and contended it was merely a toy weapon used to excite the crowd. The court rejected this narrative, convicting him on five counts last year, including unlawful possession of a firearm and reckless endangerment.
A conviction of this magnitude carries severe implications for Malema’s standing in South Africa’s multi-tiered legal and political systems.
Disqualified from Parliament?
The five-year sentence effectively disqualifies Malema from serving as a lawmaker in parliament. However, given the lengthy appeal process expected to reach the Constitutional Court, it may be years before any punishment officially comes into force.
A Distraction Ahead of Elections
While Malema may use the case to galvanize his die-hard supporters, his legal travails will serve as a massive distraction. The EFF is currently gearing up to contest municipal elections before February, a critical time given that the party’s support has recently declined following high-profile defections.
True to form, Julius Malema is unlikely to tone down his fiery public rhetoric as a result of the conviction.
Unrepentant Defiance
Addressing hundreds of supporters outside the court, Malema called Magistrate Olivier "incompetent" and "racist," alleging without direct evidence that the conviction was the result of a political conspiracy. "Going to prison or death is a badge of honour," he told the crowd. "We cannot be scared of prison or to die for the revolution."
A Track Record of Controversy
Malema and the EFF, known for their red overalls and legislative brawls, have courted controversy at every turn. Just last August, he was found guilty of hate speech by the equality court following a 2022 rally where he stated, "A revolution demands that at some point there must be killing."
